Purchase

Purchasing a home encompasses a lot of transactions and paperwork. From making an offer to purchase and perhaps counter offer(s), putting down a deposit and securing a mortgage, to paying taxes and insurance and finally to making the remainder of the down payment.At our law office we are there for you at every step of the way to make sure that all the transactions and paperwork are filed accordingly and all payments have been made in full and on time. Here’s what we do during a purchase:

  • Review the Agreement of Purchase and Sale and other legal documents before you sign.
  • Check to make sure there are no existing claims against the property. If there are claims, we ensure that they are cleared before you take title.
  • Arrange for title insurance to protect you from title defects.
  • Ensure you have the valid title when the transaction closes.
  • Calculate and remit the land transfer tax due on closing.
  • Review and complete the deed to your house.
  • Draw up the mortgage documents (if necessary) and register the mortgage.
  • Close the transaction and ensure that all the legal and financial conditions are met.
  • Exchange legal documents, keys and cheques with the seller’s lawyer.

Sale

Here’s what we do during a sale:

  • Review the Agreement of Purchase and Sale and other legal documents before you sign and assist in the negotiation of its terms and conditions.
  • Deal and remedy title issues as they occur.
  • Close the transaction and ensure all legal and financial conditions have been met.
  • Exchange legal documents, keys and cheques with the buyer’s lawyer.

Re-Financing

Whether you are refinancing to consolidate debt, obtain a lower mortgage rate or take out a home equity line of credit, we are there to help you to do the following:

  • Perform title searches to ensure that there are no existing title defects.
  • Ensure you have the valid title when the transaction closes.
  • Confirm that the amount of your new mortgage is sufficient to cover all the outstanding debts, including the existing mortgage.
  • Draw up the mortgage documents (if necessary) and register the new mortgage.
  • Close the transaction and ensure that all the legal and financial conditions have been met.
